Wife and Mother dies following delay in diagnosis and negligent cancer treatment

What was the case about?
We have recently settled a case for widower Mr H whose wife died on 1 June 2003 from neutropenic sepsis. Neutropenic sepsis is the development of fever often with other signs of infection and is generally recognised as a complication of chemotherapy. Mrs H was undergoing chemotherapy treatment for breast cancer when the sepsis became apparent, it is thought this was because she was not given antibiotic cover. The claim that we helped with concerned the delay in diagnosis and treatment of the breast cancer, negligence in the administration of chemotherapy and the delay in the diagnosis and treatment of neutropenic sepsis.

What did we do and how did this benefit the client?
We started proceedings on behalf of Mrs H’s estate and his son who at age nine was a dependant in the case. Once proceedings had begun liability was formally admitted. After an exchange of expert evidence, we entered into negotiations on behalf of Mr H and obtained a stay from the Court so we could do this. We continued to assist Mr H until a settlement of £250,000 was approved by the Court.

Mr Rankeshwar Batta, Senior Associate of Anthony Collins Solicitors said that “this was an extremely sad case involving the unnecessary death of a devoted wife and mother. Thankfully liability was ultimately admitted and the majority of the damages received will be invested on behalf of my client’s son”.
